Two-Month Countdown: Democrats Regain Control of Congress, Crypto Firms' Compliance Response and Strategic Shift

Democrats' takeover of both chambers of Congress in the midterms has effectively killed the Clarity Act, the market structure bill that passed the House 294-134 in July 2025 but stalled in the Senate after a failed September 15 procedural vote, with prediction markets now pricing single-digit odds of enactment before 2027. The lame-duck session before the new Congress seats on January 3 leaves little room for progress, and industry figures including Duke researcher Lee Reiners and Genius COO Ryan Myher say the current version is dead, with a redrafted bill likely in 2027 featuring stricter AML, DeFi and conflict-of-interest provisions. The shift matters because crypto PACs spent roughly $170 million backing Republicans and attacking Democrats to little avail, and from January Democrats will control committee gavels and subpoena power, making hearings on consumer protection, illicit finance and conflicts of interest—potentially including presidential-family crypto ventures—a bigger near-term force than any legislation. Rulemaking will tighten regardless of Congress: OCC final guidance implementing the GENIUS Act stablecoin law takes effect January 18, 2027, bans direct and indirect yield payments to holders, and will be paired with joint Treasury-OCC AML and sanctions rules, while tokenized equities and other RWAs face heavier scrutiny. With only 4% of voters citing crypto as a ballot issue, firms are advised to treat the two-month window as a compliance planning period—strengthening AML screening, wallet-to-holder attribution and disclosures—rather than a lobbying sprint.
